Help to construct and file. First action is to file official Notice of Disagreement in writing to VA Regional Office making rating decision. VA will then issue Statement of Case showing what evidence was considered and how and why they made the rating decision. Veteran then must file formal appeal on VA Form 9. The formal appeal must be completed and received by the VA within one year from the date of the rating decision. If VA continues to deny appeal, the veteran may ask for the appeal to be considered by the Board of Veteran Appeals in Washington D.C.(Takes about 2 years for this to be heard). The veteran may request a personal hearing at the VA Regional Office, or before a traveling board of the Board of Veterans Appeals in Washington D.C. or by video hearing. Please note all personal hearings are at the veterans own expense. |
