Application for Work Within the Surface Water Protection Buffer


APPLICATION FOR WORK WITHIN THE SURFACE WATER PROTECTION BUFFER

The application fee is $750 for a permit to do work within the surface water protection buffer.  If the application is for an "after-the-fact" permit, the fee is $2250. Please note that your application will not be processed and sent to a reviewer until the application fee is paid. You must call the Natural Resources Management Office to obtain a payment control number, 321-633-2016. Please indicate your method of payment when requesting the payment control number.  The application fee may also be paid in person to the central cashier or by phone using a credit card. There is a 2.95% surcharge if you use pay by phone. You may also mail a check for your application to the Natural Resources Management Office, 2725 Judge Fran Jamieson Way, Building A, Room 219, Viera, FL, 32940. 

If you would like to pay by phone:

  • Call the Natural Resources Management Office and obtain a payment control number, 321-633-2016.
  • Call the Brevard County Central Cashier Office at 321-633-2068 and give them the control number.
  • The cashier will then look up the fee for the service.
  • The cashier will then ask for your name, credit card #, expiration date, and your billing address.
  • The cashier will then run the card through a system called point and pay.
  • Your receipt will be available to you by fax or pickup at the office.
  • Please note the application fee for this service will show up on your credit card statement as PNPGOVPAY (point and pay).

In order for the Natural Resources Management Office to do a complete review, please provide the following:

Payment Control Number (obtained by telephone from the Natural Resources Management Office):

A plan showing all of the following features and proposed work:
CHECK LIST
Property boundaries and dimensions
Name and location of any adjoining public streets and roads
Location and dimensions of all existing structures
Label all impervious and altered areas and indicate their square footage
Boundaries of wetlands or other surface waters, identifying open water areas
A description and depiction of the proposed work
The direction of drainage relative to the proposed improvements (using arrows)
Permanent and temporary erosion, sedimentation, and turbidity controls
Boundary area and volume of all temporary and permanent earthwork, including pre and post construction grades
Engineered Stormwater management system that traps the first 1" of runoff
Rock size if applicable equal to standards in F.A.C. 40C-400.431(1)(a)  The riprap consists only of natural boulders or clean concrete rubble one to three feet in diameter in average dimensions.
Show how filter fabric will be used
Supporting documents:
Pictures of existing buffer/shoreline
Length of shoreline
A cross section of the proposed work (include dimensions, slope, filter fabric, plantings, and rock size for rock revetments)
Show the planting plan, if applicable, with plant sizes and centers

If you cannot attach all required documents below, this Office requests that you mail the application or call for an appointment.  This will ensure checklist items are not separated from your application.

It is the responsibility of the applicant or the their authorized agent to provide clear and convincing evidence in this application that the proposed work will not:

  • Adversely impact water quality.
  • Result in the loss of shoreline and aquatic vegetation.
  • Adversely affect adjacent properties.
  • Adversely affect biological communities.
  • Increase the waterward extension of the existing shoreline, except where bulkheads must be parallel and in line with adjacent bulkheads.
  • Adversely affect the flow of water or create a navigational hazard.

Per Section 62-3666(13) all improvements, mitigations, and special conditions approved shall be required to be installed, constructed, and maintained in a viable, approved, functional working order. All applicants shall be subject to and responsible for obtaining all additional necessary permits, prior to Brevard County approval. State or federal approval of shoreline hardening shall not exempt the applicant from County approval or denial of the project. All appeals of decisions of the Natural Resources Management Office shall be subject to the provisions of Section 62-507 of the Brevard County Code.
